BONGBONG MARCOS FILES ELECTION PROTEST BEFORE THE SUPREME COURT OF THE PHILIPPINES

Senator Ferdinand Marcos
Jr.personally filed his election protest before the Supreme Court, representing the
Presidential Electoral Tribunal (PET).
Ferdinand 'Bongbong' Marcor Jr., was accompanied by lawyers and Political allies,
in a 1,000 page petitioned, PET to set
aside the proclamation of Ma.Leonor Robredo and proclaim him
instead as the duly elected and
rightful Vice-President of the
Philippines.
BongBong Marcos also submitted a
20,000 pages of affidavits, Certificates of Canvass and other supporting
documents which is according to him
would provide clear and convincing
evidence to prove the biggest electoral
fraud in the history of Philippine politics.
His election lawyer George Garcia,
pointed out that through a series of electoral frauds, anomalies and irregularities, people behind the whole
operation made sure that Ms. Robredo
would win and that Marcos votes would be reduced.
The petition stated that “The
votes presumably obtained by protestee Robredo during the last elections are products of electoral fraud, anomalies
and irregularities. Furthermore, the votes of
BongBong Marcos were significantly reduced , manipulated and altered to make it appear that he only
placed second during the last elections.” He is specifically contesting
the election results in 39,221 clustered precincts in 25 provinces and 5
highly urbanized cities all over the
country.

In a Press Conference at Max Restaurant BongBong Marcos revealed that
his petition has three parts:
1.) The “Flawed” Automated Election System (AES).
2.) It concerns more of
Traditional modes of cheating like vote buying, pre-shading, intimidation and failure of elections, among others.
3.)The third focuses on the unauthorized
introduction of Smartmatic’s Marlon Garcia of a new hash code (or a new
script/program) into the Transparency Server as well as the effects brought
about by the unauthorized cosmetic change/manipulation.
Based on numerous testimonies and
documentary evidences several violations were solidified and committed by
both Commission on Election and
Smartmatic.
a.) R.A.9369 requires, among others, that the AES to be used by COMELEC should “have demonstrated capability and been successfully used in a prior electoral exercise here or abroad”. However the Vote Counting Machines (VCMs) supplied by Smartmatic as a component of AES was an entirely new model ! It was never before used or supplied by Smartmatic for any election, locally or abroad;
a.) R.A.9369 requires, among others, that the AES to be used by COMELEC should “have demonstrated capability and been successfully used in a prior electoral exercise here or abroad”. However the Vote Counting Machines (VCMs) supplied by Smartmatic as a component of AES was an entirely new model ! It was never before used or supplied by Smartmatic for any election, locally or abroad;
b.)Thirteen (13) days before the election day,
COMELEC issued a resolution ordering the
BOC’s not to transmit the Certificate of Canvass (COC) until all SD cards from
the VCMs would have been uploaded or imported into their Consolidation and
Canvassing System (CCS).
c.) Six
(6) days before elections , the COMELEC set up seven (7) regional hubs the reconfiguration of SD cards without prior
notice to the political parties and candidates , or any announcement thereof to
the public . All this time, the national and local candidates thought that the
SD Cards were being configured solely
at the Configuration room in the Sta. Rosa facility of Smartmatic / COMELEC .
d.) Instead
of being replaced by standby CCS, thirty (30) affected CCSs were pulled
out of the BOC’s custody, upon the order of COMELEC, through Executive Director
Jose M. Tolentino.
e.) Unauthorized introduction of a new program into the Transparency Server and the apparent use of fourth server ( called the Queue Server ) that was not subject to review by political parties and candidates required by R.A.93
BongBong Marcos in a Press conference pointed out that during the 2016 May 9th election the voting public was made to believe that all electoral data received by the three servers DIRECTLY from the VCM’s and that these were secured by digital signatures and coded encryptions.this was a far cry from what truly took place.
“Data had to pass through the
fourth server and it was here where the
results were encrypted and de-crypted.This being the case ,the integrity of the
Data subsequently received by the CCSs, the Central Server and the Transparency
Server could no longer be relied uponsince the purpose of encryption
of the Data transmission is precisely to prevent alteration or change” BongBong said.
Marcos also noted that soon after the unauthorized new program
was introduced at around 8:30 pm. On May 9th, there
appeared to be an abnormally high
turn-out of unaccounted
overvotes of around 3 million for
the position of Vice-President.
The accuracy of the poll results
and the reported irregularities should therefore be thoroughly investigated and
determined, through the immediate conduct of Judicial Revision /Recount of the
Ballots and the examination, system audit and verification of the voter’s
receipts, election returns and related election documents.
