To carry out the Department Labor and Employment’s national and regional action plans on eliminating ‘endo’ and other illegitimate forms of contracting, Labor and Employment Secretary Silvestre H. Bello III has directed for the training of regional directors, technical service division chiefs, mediator-arbiters, and labor laws compliance officers (LLCO) in determining labor-only contracting (LOC).

“Labor-only contracting, which is an arrangement where the contractor or subcontractor merely recruits, supplies, or places workers to perform jobs, work or services for a principal, is prohibited,” Bello said.

Through a training workshop jointly implemented by the DOLE and the International Labor Organization, the participants undergo learning sessions on labor administration, labor inspection, joint assessment, as well as case analysis on contracting and subcontracting arrangements.  

Senior officials from DOLE, headed by Undersecretary Ciriaco A. Lagunzad III, and Undersecretary Joel B. Maglunsod, together with Bureau of Labor Relations Director Benjo Santos M. Benavidez, Legal Service Director Romeo M. Montefalco, Jr. National Wages and Productivity Commission Executive Director Alex V. Avila, and Bureau of Working Conditions OIC Director Alvin B. Curada serve as resource speakers in the training-workshop.

Sec. Bello said the capacity building activity prepares the labor laws compliance officers, under the supervision of DOLE regional directors, as well as other senior DOLE regional officers, in strictly implementing and enforcing the workers’ rights to security of tenure. They are also being trained to counter and stop practices that constitute ‘endo’ by identifying knowledge or policy gaps in the implementation of Department Order No. 18-A, or the rules and regulations on contracting and sub-contracting; studying different models of hiring practices in contracting arrangements; and in examining new and developing schemes in contractualization. 

“Regional directors shall have authority to declare the existence of labor-only contracting between the contractors and subcontractors, and the principals. Workers of labor-only contractor/subcontractor are considered employees of the principals,” Bello said.

Through the training, it is also expected that accuracy in documenting contractors’ profiles and assessment results in labor laws compliance system management information service will be achieved.

In support of President Duterte’s directive to eliminate ‘endo’ and other forms of illegitimate contracting, Sec. Bello has issued Labor Advisory No. 10, Series of 2016 prohibiting labor-only contracting.

The practice of labor-only contracting, according to the advisory, is deemed existent when the contractor or sub-contractor does not have substantial capital or investment in the form of tools, equipment, machinery, work premises. It is also practiced when the workers recruited and placed by such person are performing activities which are directly related to the principal business of such employer.

DOLE’s capacity building program conducted in Luzon, Visayas, and Mindanao is expected to equip the labor laws compliance officers and senior regional officials to efficiently assess business establishments’ strict compliance to labor laws and ultimately support the target of abolishing ‘endo’ and other illegitimate forms of contracting in 2017. Ipinahayag kahapon ni Kalihim Silvestre H. Bello III ang magandang balita sa repatriation assistance ng mga overseas Filipino worker (OFW) kasabay ng kaniyang pasasalamat kay King Salman bin Abdulaziz Al Saud ng Saudi sa pagaatas nito sa kaniyang Ministry of Labor na asikasuhin ang pagbibigay ng tulong sa mga OFW na nasa Saudi Arabia.

“Lubos na pasasalamat ang aming ipinaaabot kay King Salman sa kanyang pagmamalasakit sa ating mga OFW,” ani Bello, sa kanyang paghahatid ng update mula sa Philippine Overseas Labor Office sa Riyadh.

Kabilang sa mga iniatas ni King Salman ang pag-aalis ng immigration penalties dahil sa nag-expire na working visa, bayad sa eroplano ng mga OFW na pabalik ng bansa, pagkain, tulong-empleo sa mga nagnanais na magtrabaho sa ibang kompanya, at tulong legal para sa kanilang money claims.

Sinabi ni Bello na kinumpirma ng Ministry of Labor ng Saudi ang atas ng Hari upang tiyakin na mapoprotektahan ang mga karapatan ng mga banyagang manggagawa sa Saudi Oger at iba pang kompanya na naapektuhan ng krisis sa krudo.

“Ito ay isang malaking tulong sa ating pagpupunyagi na mapangalagaan ang kapakanan ng ating mga OFW,” ani Bello.

Maaari nang bumalik ng bansa ang mga manggagawang Filipino na-stranded sa Saudi Arabia dahil inalis na ni King Salman ang multa sa mga banyagang manggagawa na naapektuhan ng malawakang layoff at retrenchment. Sasagutin ng pamahalaan ng Saudi ang bayad nila sa eroplano.

Magbibigay din ng pagkain ang pamahalaan ng Saudi sa mga manggagawang nanatili sa lahat ng company camp, at ipadadala din ng Ministry of Labor ang kanilang mga abogado sa camp upang likumin ang mga money claim at iba pang kaugnay na reklamo upang maihain sa tamang lugar.

“Ipinaalam din sa amin ng Ministry of Labor na papayagan ang paglipat ng mga manggagawa sa ibang kompanya kung nanaisin pa ng mga ito na ipagpatuloy ang pagtatrabaho sa KSA. Maaaring maghanap ng bagong employer ang mga manggagawa, at ang mainam dito gagamitin ang Mega Manpower Companies para mag-alok ng trabaho sa mga manggagawa,” ani Kalihim Bello.

Ayon sa Kalihim, ipinaalam ni Ministry of Labor Director General Mohammed Al Sharekh ng KSA sa POLO-Riyadh na sa halip na hilingin sa libong manggagawa na ihain ang kanilang kaso sa Saudi Labor Office building, opisyal nilang tatanggapin ang mga kaso na kanilang makakalap mula sa camp.

Isa sa mga naging suliranin na kinaharap ng mga OWF ay nang mag-expire ang kanilang work permit matapos silang ma-retrench ng mga kompanyang nalugi dahil sa krisis sa krudo sa Middle East.

Nagtatag ang pamahalaan ng Pilipinas ng inter-agency emergency relief assistance mission, na binubuo ng Department of Foreign Affairs, Department of Labor and Employment, Department of Health, Department of Social Welfare and Development, Technical Education and Skills Development Authority, at ang Public Attorney’s Office, upang sumuporta sa kasalukuyang operasyon ng tatlong Philippine Overseas Labor Office sa KSA.

Babalik sa susunod na linggo sa Saudi Arabia si Kalihim Bello, kasama sina Undersecretary Ciriaco A. Lagunzad III at POEA Administrator Hans Leo Cacdac, upang personal na tingnan ang nasabing mission operation.

Hinati sa tatlong grupo ang mga opisyal ng DOLE, na binubuo ng labor attaches, Philippine Overseas Employment Administration lawyers, Overseas Workers Welfare Administration welfare officers, at training personnel mula sa TESDA, para sa magkakasabay na pag-deploy sa Riyadh, Jeddah, at Al Khobar. Sila ay tutulong sa pagpapatupad ng Relief Assistance Program sa pamamahagi ng pagkain, medisina, at cash assistance sa mga OFW na nasa company camps at shelters.

One-stop service center for OFWs opens Aug. 15, 2016

The Department of Labor and Employment (DOLE) is launching a one-stop shop for OFWs on Monday, August 15, where all government frontline services are made accessible to Filipinos who are currently working or planning to work overseas.

Labor Secretary Silvestre Bello III said this is in response to President Rodrigo Duterte's directive to make it easier for OFWs to avail the services of the government.

Sec. Bello said the One-Stop Service Center for OFWs (OSSCO) is located at the ground floor of the Philippine Overseas Employment Administration’s main office at Blas F. Ople Building in Ortigas Avenue corner EDSA, Mandaluyong City.

He said the one-stop service center is seen to reduce transportation expenses of OFWs and shorten the processing time of their documents.

Aside from making available to OFWs information on their respective programs and services and responding to queries of clients, the various government offices’ services to OFWs are as follows:

The importance of tending the Chores at Home that nurtures all who lives inside the house is a beautiful thing.

In the recent past, the term women's work has come to have a derogatory connotation. 

Women's work encompasses all the domestic chores that have historically been associated only with women—cooking, cleaning, and raising children. 

Whenever a person is limited to only certain kinds of work in a society, there is a need to break free from that work in order to inhabit a place of choice. 

However, when we choose to do women's work because we enjoy it, there is nothing degrading about it. 

There is an honor to it, and when done alone or in a group this work can be truly meaningful and fulfilling because the home is the foundation of security for all who live in it. 

In addition to being essential to the functioning of the world, women's work offers creative fulfillment, intimate interaction, and personal satisfaction. 

The more we become aware of the significance of this realm of labor, the more fulfilling it will be to those who do the work and those who benefit from it. 

A well-set table and a delicious, healthy meal can heal us on multiple levels. Clean, crisp sheets on a bed allow us to enter a deep slumber, inspiring a sense of safety and trust. 

Our mental, physical, emotional, and spiritual health all rest upon the smooth functioning of our homes. 

The gift of women's work, which still often comes from the hands of women, now also comes from fathers, husbands, and hired help. 

Whatever the source, our sincere gratitude upon receiving these treasures reminds us of the profound value of what is traditionally known as women's work. 

The more we acknowledge the tremendous importance of this work, the more we are able to do it with a sense of pride, never feeling for a moment that our efforts are less significant or meaningful than those working outside the home—on the contrary, it is this work that makes all other work possible.

Science and Technology was created by man..for the benefit of mankind. Scientist invent and re-   invent, technology becomes useless if no one uses it. Science is borderless whether you are in another country or locally the by-product of science through research and development benefits all if  not a few. The superiority of man versus the advancement in technology should no be in conflict with ethics and the law of God. Neither it should run into conflict with mother nature.

The application of science and technology should benefit mankind thereby in so doing we are glorifying God as the source of all things. Man has always been threatened with extinction and the application of Science and Technology has the tendency to emancipate man from spiritual ignorance. To make life easier and productive  eventually bring him more closer to the image and likeness of God.

The mystery of creation becomes more evident as perceived not only by the human mind but by the heart as well. Since time immemorial the superiority of man (Adam) as the custodian of creation was unquestionable until the fall of Adam. Now the stewardship of creation will be expanded not only with science and technology but with the Trinitarian mysticism   is an account of the opening of heaven, a revelation of the Trinity’s interior life turned outward to the world, that links intimately to the sacraments, prayer, the church, and the ethical life of obedience. But, unfortunately, man's abused and negligence even threatens world peace and the environment itself. Thank God.. not all the wonders of Science and Technology has been discovered and rediscovered for the same reason as to avoid the chaotic condition that results from abused and negligence.

Senator Ferdinand Marcos Jr.personally  filed  his election protest  before the Supreme Court, representing the Presidential  Electoral Tribunal (PET).

Ferdinand 'Bongbong' Marcor Jr., was  accompanied by lawyers and Political allies, in a 1,000 page petitioned, PET  to set aside  the proclamation  of Ma.Leonor Robredo and proclaim him instead  as the duly elected and rightful  Vice-President of the Philippines.

BongBong Marcos also submitted a 20,000 pages of affidavits, Certificates of Canvass and other supporting documents which is  according to him would provide  clear and convincing evidence to prove   the biggest electoral fraud in the history of Philippine politics.

His election lawyer George Garcia, pointed out that through a series of electoral frauds, anomalies  and irregularities, people behind the whole operation made sure  that Ms. Robredo would win and that Marcos votes would be reduced.

The petition stated that “The votes presumably  obtained  by protestee Robredo during the last elections  are products of electoral fraud, anomalies and irregularities. Furthermore, the votes of  BongBong Marcos were significantly reduced , manipulated  and altered to make it appear that he only placed second during the last elections.”  He is specifically  contesting  the election results in 39,221 clustered precincts in 25 provinces and 5 highly urbanized  cities all over the country.

In a Press Conference at Max Restaurant  BongBong Marcos revealed that his petition has three parts:

1.) The “Flawed” Automated Election System (AES).

2.) It concerns more of Traditional modes of cheating like vote buying, pre-shading, intimidation  and failure of elections, among others.

 3.)The third focuses on the unauthorized introduction of Smartmatic’s Marlon Garcia of a new hash code (or a new script/program) into the Transparency Server as well as the effects brought about by the unauthorized cosmetic change/manipulation.

Based on numerous testimonies and documentary evidences  several  violations were solidified and committed by both Commission on Election  and Smartmatic. 

a.) R.A.9369 requires, among others, that the AES to be used by COMELEC should “have demonstrated capability and been successfully used  in a prior electoral exercise here or  abroad”.  However  the Vote Counting  Machines (VCMs) supplied by Smartmatic  as a component of AES was an entirely new model ! It was never before used or supplied  by Smartmatic for any election, locally or abroad;

      b.)Thirteen (13) days before the election day, COMELEC issued a resolution  ordering the BOC’s not to transmit the Certificate of Canvass (COC) until all SD cards from the VCMs would have been uploaded or imported into their Consolidation and Canvassing System (CCS).

     c.) Six (6) days before elections , the COMELEC set up seven (7) regional hubs  the reconfiguration of SD cards without prior notice to the political parties and candidates , or any announcement thereof to the public . All this time, the national and local candidates thought that the SD Cards were being  configured  solely  at the Configuration room in the Sta. Rosa facility of   Smartmatic / COMELEC .

     d.) Instead of being  replaced by standby  CCS, thirty (30) affected CCSs were pulled out of the BOC’s custody, upon the order of COMELEC, through Executive Director Jose M. Tolentino.

  
e.) Unauthorized introduction of  a new  program  into the Transparency  Server  and the apparent  use of  fourth server ( called the Queue Server ) that was not subject  to review  by political  parties  and candidates  required by R.A.93 

                                               
BongBong Marcos in a Press conference pointed out that during the 2016 May 9^th election the voting public was made to believe  that all electoral data received  by  the three servers  DIRECTLY from the  VCM’s and that these were secured  by digital signatures and coded encryptions.this was a far cry from what truly took place.

“Data had to pass through the fourth server and it was here  where the results were encrypted and de-crypted.This being the case ,the integrity of the Data subsequently received by the CCSs, the Central Server and the Transparency Server  could no longer  be relied uponsince the purpose of encryption of the Data transmission is precisely to prevent  alteration or change” BongBong said.

Marcos  also noted that soon after  the unauthorized new  program  was  introduced at around  8:30 pm. On May 9^th, there appeared to be an abnormally high  turn-out of unaccounted  overvotes  of around 3 million for the position  of Vice-President.

The accuracy of the poll results and the reported irregularities should therefore be thoroughly investigated and determined, through the immediate conduct of Judicial Revision /Recount of the Ballots and the examination, system audit and verification of the voter’s receipts, election returns and related election documents.
